1. Protected cityscape Binnenstad — monuments and building restrictions
The entire Binnenstad (city centre) of 's-Hertogenbosch is designated as a protected cityscape under the Monuments Act. This is the strictest form of spatial protection available in the Netherlands. What does this mean for your parcel?
- ✓Every visible building modification — facade changes, roof extensions, street-facing additions — requires not only an environmental permit but also a monuments permit or aesthetic review.
- ✓Wooden facades and ornaments in streets like Hinthamerstraat, Kruisstraat and Vughterstraat may not simply be replaced. Even painting in non-standard colours can trigger an aesthetic review.
- ✓National monuments: 's-Hertogenbosch has hundreds of national monuments, concentrated in the Binnenstad around St John's Cathedral, the Markt and the canals. 2. River clay, peat remnants and foundation risk in older neighbourhoods
's-Hertogenbosch sits on the transition from Brabant's higher sand grounds to the river landscape of the Maas. The subsoil is therefore mixed: 65% of postcode areas cannot be classified under a single dominant soil type, 21% lies on higher sand grounds and 14% in the river area with river clay and localised peat remnants.
In the older neighbourhoods — notably De Muntel (a sought-after 1930s district near the centre), the Binnenstad, Hinthamerpoort and De Vliert — a significant proportion of buildings stand on wooden pile foundations. According to the national foundation risk map, 14% of postcode areas fall within a vulnerable attention area. About 39% of the 85,855 properties date from before 1970 — the rule of thumb for where wooden pile foundations are still relevant.
Wooden piles are vulnerable to dry conditions: when the groundwater level drops — through dry summers, drainage or climate change — the pile tops emerge above the water and pile rot can set in. In a district like De Muntel, where buildings stand on river clay with underlying localised peat, foundation risk in older properties is real. Post-war neighbourhoods such as Maaspoort, De Haren and Rosmalen typically stand on concrete piles and fall outside the classic foundation problems.
The foundation risk has been mandatory in the appraisal report since 1 April 2026. 3. Permit-free building in 's-Hertogenbosch — what is and is not allowed

- ✓Leasehold: in 's-Hertogenbosch leasehold is limited, but where it applies — for instance on certain housing corporation lands — an extension also requires permission from the lessor.
